ديناميکية الأزهر الفقهية وأثرها علي قضية التکفير
يحاول البحث معالجة قضية التکفير وموقف مؤسسة الأزهر منها بعد أن طالب البعض الأزهر بتکفير الجماعات الإرهابية أمثال داعش وغيرها ورفض الأستاذ الدکتور أحمد الطيب شيخ الأزهر أن يکفّر هذه الجماعات. واعتمد البحث علي المنهج التاريخي الديني للوقوف علي هذه الإشکالية من خلال الفقه الإسلامي وملائمته لکل زمان ومکان وحرص الأزهر علي التمسک بصحيح الإسلام بدون مزايدات أو ضغوط من هنا أو هناک.
يتناول المبحث الأول ديناميکية الفقه الإسلامي من خلال محورين اولاهما نشأة وتطور الفقه السني، وثانيهما ديناميکية الأزهر الفقهية بداية من نشأته الشيعية وانتهاءا بالتزامه بالمذهب السني من خلال المدارس الفقهية الأربعة (الحنفية والمالکية والشافعية والحنبلية) وتمسکه عقائديا بالمذهب الأشعري الذي يمثل الوسطية والاعتدال في الإسلام، ويجمع ما بين الثبات والمرونة ولا يکفر أحدا.
ويتناول المبحث الثاني قضية التکفير في الفقه الإسلامي، کما يسلط الضوء علي آراء الفرق الإسلامية أمثال أهل السنة والجماعة والخوارج والمعتزلة والمرجئة والشيعة حول مفهوم الإيمان والکفر.
ويتناول المبحث الثالث موقف الأزهر من الفرق والتيارات الإسلامية المعاصرة أمثال الشيعة والجماعات الإسلامية والتيارات العلمانية. وعلى الرغم من موقف الأزهر من عدم تکفير داعش، إلا أنه لم ينظر لهذا التنظيم الهمجي باعتباره کغيره من المسلمين، بل اعتبرهم مفسدين في الأرض، مستحقين للعقاب وطالب بتطبيق حدّ الحرابة عليهم.
وخلصت الدراسة إلي التأکيد علي ديناميکية الفقه الإسلامي وعدم جموده وصلاحيته لکل زمان ومکان. وإن قام الأزهر وأعطي لنفسه حق تکفير وحجب الإيمان عن فرد أو جماعة بدون إعمال الضوابط الشرعية فسنکون أمام تجربة تحاکى وتماثل ما يفعله الإرهابيون. وانتهت الدراسة إلي أن امتناع الأزهر عن التکفير مرتبط بموقف شرعي مُتفق عليه بين أهل السنة يستند إلى ضوابط محل إجماع من الأقدمين والمحدثين، ومسنودة بأحاديث شريفة للنبي محمد عليه الصلاة والسلام، ولم يکن موقف الأزهر، وعلى رأسه شيخه الطيب، بدعاً في التاريخ الإسلامي، فموقفه من عدم التکفير له سوابقه التاريخية.


The Jurisprudential Dynamism of al-Azhar and its Impact on the Question of Takfir
This paper examines the question of takfir and the position of the institution of al-Azhar from this question, especially after some demands that al-Azhar should excommunicate terrorist groups such as Daesh. The Sheikh of al-Azhar Prof. Dr. Ahmed al-Tayyib, however, did not respond to these demands. The paper utilizes the legal historical methodology to examine this issue from the perspective of Islamic Law and its adaptability to time and space; and the keenness of al-Azhar to hold to the proper teachings of Islam, without bargaining or surrendering to pressures.
Focusing on the dynamism of Islamic law, part one is divided into two sections. Section one studies the emergence and the development of Sunni fiqh. Section two demonstrates the fiqhi dynamism of al-Azhar from its shi`i start to finally its commitment to the sunni legal tradition of the legal fiqhi schools (Hanafi, Maliki, Shafi`i and Hanbali) and its theological adherence to the Ash`ari school, which represents the Islamic middle-way and moderation. A-Azhar’s approach combines stability and flexibility at the same time and does not excommunicate others.
Part two analyses the question of takfir in Islamic law and sheds some light on the opinions of theological schools such as Ahl al-Sunnah wa-l-Jama`ah, Kharijites, Mu`tazilite, Murji’ite, and Shi`ite concerning the concepts of faith and disbelief.
Part three discusses the stance of al-Azhar from contemporary Islamic trends andsects such as Islamic groups and secular trends. Though the position of al-Azhar of not excommunicating Daesh, it does not consider this organization similar to other Muslims. Al-Azhar considers the adherents of these groups as mischief doers on earth, deserving punishments, especially the application of banditry punishment. If al-Azhar gives itself the right to excommunicate other without strict legal regulations, its actions will be similar to what terrorists do, i.e. of excommunicating others without sound ground. The paper concludes that the position of al-Azhar of not excommunicating others relies on an agreed-upon legal principle that is based on scholars’ consensus, let alone the traditions of the Prophet, peace be upon him. This position of al-Azhar, and of its Sheikh, Prof. Dr.Al-Tayyib, is not a new thing in Islamic history. This position has its own historical precedents.
